PURPOSE OF THE PUBLIC HEARING
The purpose of the public hearing is to receive comments from all interested persons regarding the Adoption of regulations that pertain to chapter 408 of the Nevada Administrative Code. A copy of each of the proposed permanent regulations is attached following the agenda.
The following information is provided pursuant to the requirements of NRS 233B.0603:
I. Regulation providing a process for the delegation of authority of the Board of
Transportation to the Director of the Department of Transportation.
1. Existing law authorizes the Board of Transportation to delegate its authority under chapter 408 of the Nevada Revised Statutes to the Director of the Department of Transportation. The regulation creates a method for such delegation of authority consistent with the Nevada Open Meeting Law and Nevada Administrative Procedures Act.
2. The approved or revised text of the proposed regulation may be obtained from:

3(a) This regulation does not apply to businesses. The public benefits from the Department of Transportation having a transparent process developed with public and legislative oversight for the Board of Transportation to Delegate its authority to the Director of the Department of Transportation.
3(b) There is no estimated immediate economic effect on business or the public.
4. The impact on small business was determined by reaching out to a collection of small businesses doing work for the Department of Transportation to receive their input on the regulation.
5. The estimated cost to the Department of Transportation for enforcement of the proposed regulation is negligible as the delegation of authority processes described in the regulation are consistent with the Department of Transportation’s current methods.
6. The proposed regulation does not overlap or duplicate a regulation of other state or local
agencies. The Federal Highway Administration is the regulating agency.
7. The proposed regulation does not establish a new fee or increase an existing fee.
II. Regulation relating to procurement of public-private partnerships for transportation facilities.
1. Existing law provides that in a county with a population of 700,000 or more (currently only Clark County), a public body, including, without limitation, the Nevada Department of Transportation, is authorized to procure a public-private partnership to plan, finance, design, construct, improve, maintain or operate or any combination thereof, a transportation facility. This regulation is needed to establish a transparent process and requirements for a public agency to procure a public-private partnership through the solicitation of proposals. This regulation provides detailed procurement steps to be followed by public agencies in the procurement of a public-private partnership.

The public benefits from public agencies having a transparent procurement process developed with public and legislative oversight which encourages competition because it results in more cost-effective projects using fewer tax dollars.
3(b) The estimated immediate economic effect on business is the normal cost of doing business in competing for work. There are no anticipated long-term economic effects on business. The immediate and long-term economic effect on the public is better use of tax dollars for public projects.

1. Existing law provides that the Nevada Department of Transportation is authorized to procure a highway project using the design-build alternative procurement method. This regulation is needed to establish a transparent process and requirements for the Department of Transportation to procure a design-build project through the solicitation of proposals. This regulation provides detailed procurement steps to be followed by public agencies in the procurement of a design-build project.

The Department will consider and prepare responses to each of the public comments, if any. The Department will submit the adopted regulations to the Legislative Commission for approval.
• In the event that a substantial revision is made to a proposed regulation as a result of a public comment, the Department must resubmit such regulation to the Legislative Counsel Bureau for approval of the revised text, and an additional public hearing must then be held for such substantially revised regulation.

In-person and Virtual Public Information Meeting for Reno Spaghetti Bowl Project - Phase 2A Design Modification
VIRTUAL PUBLIC MEETING INFORMATION: The public meeting will be available 24 hours a day via the internet at www.ndotspaghettibowl.com from Tuesday, May 26, through Friday, June 26, 2026. Comments will be accepted until 5:00 p.m. Friday, June 26, 2026.
IN-PERSON EVENT: The in-person event will be held on Thursday, June 11, 2026, at Sparks Library, 1125 12th Street, Sparks, NV 89431. The meeting will begin with an open house period at 4:00 p.m., followed by a formal presentation and question-and-answer session at 5:30 p.m. The event will conclude at 7:00 p.m.
LIVESTREAM INFORMATION: The formal project presentation will be livestreamed on Thursday, June 11, 2026, at 5:30 p.m. via the NDOT Facebook page (@NevadaDOT). Livestream participants will be able to comment and ask questions via Facebook.
PURPOSE OF THE MEETING: The Nevada Department of Transportation (NDOT), in cooperation with the Federal Highway Administration (FHWA), invites you to participate in a public information meeting to learn about a design modification to the Reno Spaghetti Bowl Project – Phase 2A.
Phase 2 is the continuation of the Reno Spaghetti Bowl Project and is split into two subphases: Phase 2A (Rock Blvd to East McCarran Blvd) and Phase 2B (East of the Spaghetti Bowl to Rock Blvd). Phase 2A will:
- Widen I-80 from Rock Blvd to East McCarran Blvd
- Partially reconstruct the Rock Blvd interchange
- Reconstruct the Pyramid Way interchange
- Build a new I-80 viaduct bridge between Rock Blvd and Pyramid Way
The design modification of Phase 2A realigns I-80 to the north, beginning east of SR 668 (Rock Boulevard), extending east for approximately 1/2 mile, and reconnecting to existing I-80 at SR 445 (Pyramid Way).
The design modification could result in impacts that differ from those identified in the 2019 Reno Spaghetti Bowl Final Environmental Impact Statement (EIS)/Record of Decision (ROD). NDOT is currently identifying and documenting any potential effects.
The meeting will be held online and in person to share information about the proposed Phase 2A design modification and gather feedback on potential impacts. The project design is based on extensive engineering and environmental analysis, and your input will help NDOT understand community concerns and address them as the project moves forward.
PURPOSE OF THE PROJECT: The Reno Spaghetti Bowl Project – Phase 2A will enhance safety and mobility on I-80 from Rock Boulevard to East McCarran Boulevard, including proposed widening of the interstate to three lanes in each direction.

DRAFT PROPOSED REGULATION OF
THE DEPARTMENT OF TRANSPORTATION
The following document contains the initial draft regulation proposed by the Department of Transportation (“Department”) for a definition of “critical infrastructure” as used in NRS 239C.210(2)(b). The Department will solicit comments from the industry on the proposed regulation pursuant to NRS 233B.0608(1) to determine whether the regulation would likely impose a direct and significant economic burden upon a small business or directly restrict the formation, operation, or expansion of a small business. The Department will consider all comments and address the industry’s concern(s), if any.
Purpose: The purpose of this regulation is to provide a definition of the term “critical infrastructure” as it is used in NRS 239C.210 to determine which Department assets, facilities, systems, or networks, whether physical or virtual, must be protected from disclosure in accordance with NRS 239C.210.
Authority: NRS 408.215(4).
Explanation: Material in blue bold italics is new language; material in [bold brackets] is to be omitted from current regulation. All comments received from the small business impact notice will be considered but not all may be addressed. The matters to be addressed will be referenced in this draft as italics for revised and matters in brackets [omitted material] is language to be omitted.
Section 1. Chapter 408 of NAC is hereby amended by adding thereto a new section to be designated NAC 408.XXX, as follows:
Sec. 2. NAC 408.XXX “Critical Infrastructure” defined. “Critical infrastructure” means Department assets, facilities, systems, or networks, whether physical or virtual, that are under the jurisdiction of the Department and whose incapacitation or destruction would result in a significant impairment to the State of Nevada’s transportation security, economic continuity, public health, or welfare and includes, without limitation: (NRS 408.215, NRS 239C.010, NRS 239C.210)
(1) Routes, facilities, or other assets designated in the Department’s Transportation Policies;
(2) Structures that meet the definition of a bridge as established by the American Association of State Highway and Transportation Officials (AASHTO);
(3) Structures that meet the definition of a tunnel as established by AASHTO;
(4) Stormwater assets and water treatment facilities;
(5) Railroads and railroad crossings;
(6) Electrical, telecommunication, fiber optic, radio, and water utility systems and associated data;
(7) Buildings, data centers, above-ground structures, and vertical facilities owned, operated, or leased by the Department;
(8) Routes providing access to or from Harry Reid International Airport and Reno-Tahoe International Airport.
(9) Systems or devices that interact with or monitor any physical infrastructure in subsection (1) through (8) of this chapter;
(10) Virtual and on premises systems, devices, networks, or other Information Technology (IT) that facilitate Department cyber operations or cyber security; and
(11) Any similar critical infrastructure-related assets as may be designated.
Sec. 3. Chapter 408 of NAC is hereby amended by adding thereto a new section to be designated NAC 408.XXX, as follows:Sec. 4. NAC 408.XXX All data, information, and records pertaining to “critical infrastructure” as defined in this chapter are deemed restricted and are exempt from public disclosure in accordance with NRS 239C.210.
Sec. 5. Chapter 408 of NAC is hereby amended by adding thereto a new section to be designated NAC 408.XXX, as follows:
Sec. 6. NAC 408.XXX The provisions of [Sections 2 and 4] are hereby declared to be severable. If any provision or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the regulation which can be given effect without the invalid provision or application.
Sec. 7. This regulation shall become effective upon filing with the Secretary of State in accordance with NRS 233B.070.
