Welcome to NDOT Right-of-Way  

The NDOT Right-of-Way Division is responsible for the acquisition of real property needed for highway purposes, the relocation of displaced persons and businesses, utility coordination, permits, and property management functions. NDOT Right-of-Way is also responsible for the oversight of local government highway projects using State and Federal funds. 

The Right-of-Way Division consists of four sections: 1) Administration and Property Management, 2) Acquisitions and Appraisals, 3) Utilities and Railroads, and 4) Survey Services.  Together, these four sections administer all phases of the NDOT Right-of-Way program.

Property Management

The Property Management Section oversees and manages the lands and improvements acquired for right-of-way purposes until construction begins and after construction is complete. This involves securing and maintaining the property and improvements and putting the unused properties to beneficial use by selling them or leasing them for non-highway uses.

Acquisition and Appraisals

The Acquisitions Section is responsible for the timely securing of those real property rights necessary to the certification of a project so that construction of the Department’s facilities may commence. This section also assists with the relocation, advisory assistance, and reimbursement of displaced persons and businesses.

Utilities and Railroads

Because traditionally, highways and utility facilities frequently coexist within the common right-of-way or along the same transportation corridor, the Utilities Section oversee the adjustment and relocation of utility facilities for when Department projects impact the utility facilities located within the project footprint.

Survey Services

The Survey Services section provides land surveying and title information required in the transfer of real property for State and Federal highways of the State. Survey Services also maintains the property rights for all property owned by the Department.
