Use of the Right-of-Way

NDOT's right of ways may also be used by the public as long as it does not interfere with the use and safety of the traveling public. Requests for Lease, Airspace lease or a Temporary Use may be submitted to the Property Management Section for review and evaluation. NRS 408.507 authorizes NDOT's Director to lease any fee owned property at fair market value that it believes is in the best interest of the state. All agreements require a permit and will be evaluated on a case-by-case basis. 

Temporary Use Agreement 

These are needed for events or activities of a short duration (usually <1 month) that disrupts the flow of traffic, such as racing events, parades, and filming.

Multi-Use Lease Agreements

A lease is required on strips of land along the right-of-way that NDOT owns if the abutting property owner is using it for purposes such as parking, fencing or mixed landscaping.

Multi-Use Airspace Agreements 

These are required for leased areas above or below the highway NDOT owns, such as parking under an overpass or a tram above the highway.

AIRSPACE LEASES: Sealed Bid Notice 

All proposed Right-of-Way Use Agreements for airspace must be published in a local newspaper prior to final selection of the prospective lessee. The lease will be awarded to the highest bidder. Please bookmark this site for airspace lease auction announcements.

NRS 408.533 authorizes NDOT to sell property that it has determined is in excess of its needs. To submit a request to purchase an NDOT owned property, complete the Excess Property Request Form: Excess Property Request Form
